In a notable judgment, the Indore Family Court rejected a woman’s plea for maintenance from her husband, citing the absence of a legitimate reason for her separation. The court observed that although the wife, Sulochana, is not financially self-sufficient and the husband has failed to support her, she has not provided any legally valid justification for living separately.
The verdict was delivered by First Additional Principal Judge Dhirendra Singh, who stated that under such circumstances, the wife is not entitled to maintenance. However, since the couple’s two minor children reside with the mother, the court ordered the husband, Aman, to pay ₹15,000 monthly for their upkeep.
Advocate Krishnakumar Kunhare, representing the husband, informed that Sulochana had filed a domestic violence and dowry harassment complaint in May 2022, nearly nine years after their marriage in 2013. She demanded ₹17,000 for herself and ₹18,000 for the children as maintenance, claiming Aman earned ₹1.5 lakh per month. Aman denied all allegations, stating his monthly income is only ₹60,000.
Considering the income and circumstances, the court dismissed the wife's claim for personal maintenance while upholding the children's right to financial support.
